Judge Neil Rafferty KC thanked the victim for coming forward and described the defendant’s guilty plea as “the gold standard of vindication for you as a victim” before imposing his punishment.
The victim had reported to police on October 5, 2022, that she had been sexually assaulted by a friend, according to the judge’s summary of the case’s circumstances.
The court heard that the defendant and the victim and others had been socialising together.
The victim, another individual, and McElhinney returned to his flat to continue drinking, the judge said, and it was decided that the victim would spend the night there since “she had done before.”
The victim and the defendant were not, and had never been, in a romantic connection, the court emphasised.
The victim went to bed, the court heard, and a while later woke up to find the defendant on top of her, having stripped her naked.
